В предновогоднем эфире «Радио Москвы» в программе «Де-юре», которая проводится совместно с информационно-правовым порталом «Закония», президент Федеральной палаты адвокатов РФ Юрий Пилипенко рассказал о значимых для адвокатского сообщества юридических и законотворческих итогах года.
Для российской адвокатуры уходящий год был во многом знаменательным. Прежде всего это касается состоявшегося Восьмого Всероссийского съезда адвокатов, на котором были приняты знаковые поправки в Кодекс профессиональной этики адвоката, имеющие своей целью защиту деловой репутации корпорации.
Второе событие, о котором рассказал президент ФПА РФ, касалось дополнительных гарантий адвокатской деятельности и адвокатуры, которые в 2017 г. были нормативно закреплены в УПК РФ по инициативе Президента Российской Федерации. «Поправки существенным образом отразились на защищенности адвокатов как процессуальных фигур, – объяснил Юрий Пилипенко. – В частности, речь идет о присутствии представителя региональной палаты во время обыска на территории кабинета или места жительства адвоката. Эта и другие новеллы весьма значимы, обсуждение их велось несколько лет».
Этот год запомнится также долгожданной публикацией Министерством юстиции РФ проекта Концепции регулирования рынка профессиональной юридической помощи. «Последние несколько лет интерес к реформе то просыпался, то угасал. В этом смысле год оказался замечательным: проект Концепции опубликован, и нам, российским адвокатам, он в значительной степени понравился, потому что в нем звучит здравый подход к тому, как должны быть устроены судебное представительство, юридическая профессия и так далее», – сказал президент ФПА РФ.
Были и негативные моменты, с которыми пришлось бороться в уходящем году, но самое важное, что в этом сражении удалось отстоять интересы российской адвокатуры. Юрий Пилипенко добавил, что у института своих собственных интересов очень мало, потому что «они в основном связаны с интересами граждан, которых мы защищаем».
