Генпрокуратура РФ вернула следствию материалы дела в отношении экс-сотрудника КГБ Эдуарда Буданцева, обвиняемого в убийстве двух человек во время перестрелки у ресторана Elements в Москве, сообщили РАПСИ со ссылкой на пресс-службу ведомства.
Отмечается, что причиной такого решения стало отсутствие состава преступления в действиях Буданцева.
Как сообщалось ранее, в середине декабря 2015г. возле ресторана Elements на Рочдельской улице в Москве произошла перестрелка между полицейскими и людьми предполагаемого криминального авторитета Захария Калашова (Шакро Молодого). В вооруженном конфликте участвовали 10 человек. В результате в больницу с ранениями различной степени тяжести были доставлены пятеро мужчин, двое из которых впоследствии скончались. После инцидента было возбуждено несколько уголовных дел.
Шакро Молодой был задержан по подозрению в вымогательстве восьми миллионов рублей у владелицы вышеупомянутого ресторана. Также были задержаны и заключены под стражу заместитель руководителя Главного следственного управления Следственного комитета (СК) РФ по Москве Денис Никандров, руководитель Главного управления межведомственного взаимодействия и собственной безопасности СК России Михаил Максименко и его заместитель Александр Ламонов.Изначально Буданцеву вменялась статья «Убийство двух лиц», которая затем была смягчена на «Превышение мер необходимой самообороны». По этой статье подозреваемому грозит до двух лет лишения свободы. Но и после этого Генпрокуратура вернула дело на доследование.
